Tvl. Ranjini Enterprises v. State Tax Officer — Madras High Court (Madurai Bench), W.P.(MD) No. 5172 of 2024, decided 5 March 2024 (B. Pugalendhi J.) · 2024-03-05

A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.

If your supplier reports the invoice in GSTR-1, the credit flows into your GSTR-2B and you may claim it, but if that supplier has not filed the GSTR-3B for the same period by 30 September following the end of the financial year, you must reverse the credit in a return filed on or before 30 November. Reversal done within this window carries no interest; delay beyond it attracts interest at 18 percent. The credit can be re-availed once the supplier eventually files GSTR-3B. A supplier filing-status check is therefore now part of any serious reconciliation for businesses in Adyar.
My company in Adyar is dormant. Is there a cheap way to stay GST compliant?

No, not until it appears. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. So a Adyar trainer running a workshop in Hyderabad for a registered Chennai company charges CGST plus SGST of Tamil Nadu, but the same workshop sold to unregistered individuals is taxed in Telangana. Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Adyar use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
Which everyday goods now attract 5 percent GST?

How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
