The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.

What it means for you: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. Since 1 January 2022, Section 16(2)(aa) permits ITC only on invoices furnished by the supplier in GSTR-1 and communicated to you in GSTR-2B; the earlier provisional credit tolerance is gone. Claiming credit on a missing invoice invites a Rule 88D intimation and reversal with interest at 18 percent. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Vendor discipline clauses in purchase orders help enormously.
I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Under Section 18(6) read with Rule 44, on supply of capital goods on which credit was taken, you must pay the higher of two amounts: the ITC originally availed reduced by five percent per quarter or part thereof from the invoice date, or the tax on the transaction value of the sale. For example, machinery held for three full years has its credit reduced by sixty percent, and you compare the remaining forty percent with the actual tax on the sale price. Refractory bricks, moulds, dies, jigs and fixtures sold as scrap need tax only on transaction value. Compute both figures before invoicing the buyer.
How and when can I opt in or out of the QRMP scheme?
The option is exercised on the GST portal under Services, Returns, Opt-in for Quarterly Return. The window for any quarter runs from the first day of the second month of the preceding quarter to the last day of the first month of the quarter you are opting for. For example, to be under QRMP for July to September, opt in between 1 May and 31 July. Once chosen, the option continues for future quarters until you change it or your turnover crosses Rs.5 crore. Is GST still charged on health insurance premiums?
Not on individual policies. With effect from 22 September 2025, premiums on all individual life insurance policies and individual health insurance policies, including family floater and senior citizen plans, are exempt from GST, along with their reinsurance. Earlier these attracted 18 percent, so the change directly reduces the premium outgo for households. Group policies taken by businesses for employees continue to be taxable, and the input tax credit position on such group covers still depends on whether the cover is statutorily obligatory. When renewing policies, check that the insurer has passed on the exemption rather than merely repricing the premium.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
How is GST charged on clothes and footwear after the rate change?
The rate now turns on a per-piece price line of Rs.2,500. Apparel, made-up textile articles and footwear with a sale value up to Rs.2,500 per piece attract 5 percent GST, while pieces priced above Rs.2,500 attract 18 percent.
