A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Torrent Power Ltd v. Union of India — Gujarat High Court, R/Special Civil Application No. 5343 of 2018, judgment dated 19 December 2018 · 2018-12-19

Circular No. 34/8/2018-GST had stated that services such as meter rent, application fees and shifting of lines supplied by an electricity distribution utility are taxable separately. The High Court struck down paragraph 4(1) of that circular, holding that these services are naturally bundled with the exempt supply of transmission and distribution of electricity and therefore take the character of the principal exempt supply. A circular cannot narrow the scope of an exemption notification.

What it means for you: Departmental circulars do not have the force of law where they contradict the statute or notification — a useful argument when a circular is the sole basis of a demand.

Such manufacturers must declare details of every packing machine, its make, capacity and installation address, in Form GST SRM-I within the prescribed time, report any addition or removal of machines, and file a monthly statement of inputs and outputs in Form GST SRM-II. The procedure took effect from 1 April 2024 and carries a separate penalty for unregistered machines.

What is compounding of offences under GST and how much does it cost?

Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Agaram as urgent.

If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. What penalties does Section 122 of the CGST Act prescribe, and for which offences?

Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Scrutiny can be closed with a good reconciliation; an audit needs sustained document management and negotiation over weeks. Both, if unresolved, end in Section 73 or 74 demands, so early professional handling pays.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
How long can a departmental GST audit under Section 65 go on?
The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
What details must a GST tax invoice compulsorily contain?
