Circular No. 178/10/2022-GST · 2022-08-03
This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.

The Madras High Court partly allowed the petition, sustaining the seizure but modifying the prohibition order and directing provisional release of the goods on a personal bond plus a deposit of Rs. 2 lakh. The Court noted that the officers had not produced the material on which their reason to believe was founded, and took into account the severe business disruption caused by the pandemic.
What it means for you: Seized stock can often be released provisionally on bond and a modest deposit while the investigation continues, instead of remaining locked up indefinitely.
GSTN Advisory dated 3 March 2025 — biometric Aadhaar authentication for promoters and directors at any GST Suvidha Kendra in their home State · 2025-03-03
Under the risk-based process in Rule 8(4A) of the CGST Rules, a registration applicant flagged by the system must attend a GST Suvidha Kendra for photograph capture, biometric Aadhaar authentication and verification of original documents. GSTN advised during 2025 that a promoter or director may complete this step at any GST Suvidha Kendra in his or her home State, while the primary authorised signatory must still be verified at a centre in the State in which registration is sought.
What it means for you: Where a Chennai company has directors living outside Tamil Nadu, book their biometric appointments early, as registration is not granted until every required person is verified.
