CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

Entry 66 exempts services supplied by an educational institution to its students, faculty and staff, and services relating to admission to or conduct of examinations. It also exempts transportation of students, catering including any government-sponsored mid-day meal scheme, security, cleaning and housekeeping supplied to an institution, but only where that institution provides education up to higher secondary level. An educational institution is one whose output leads to a qualification recognised by law, so private coaching classes fall outside the exemption.
Why this matters: A Chennai coaching centre or competitive-exam institute is fully taxable, while a recognised school or college is exempt, and the two must never be treated alike.

The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.
