Two refund changes made in July 2022 were clarified to operate prospectively. The amended formula in Rule 89(5) for inverted duty refunds, introduced by Notification 14/2022-Central Tax, applies to refund applications filed on or after 5 July 2022, irrespective of the period to which the claim relates. The restriction on refund of accumulated credit for specified goods under Notification 09/2022-Central Tax (Rate) applies to applications filed on or after 18 July 2022.
Why this matters: The date of filing the refund application, not the tax period, decides which formula and which restriction apply to a Chennai claimant.
Volvo-Eicher Commercial Vehicles Ltd — AAAR Karnataka, order dated 6 February 2020 (appeal from AAR Karnataka, Advance Ruling No. KAR ADRG 32/2019, dated 12 September 2019) · 2020-02-06
The company repaired Volvo vehicles in India during the warranty period and recovered the cost from Volvo Sweden, which owned the warranty obligation. The Karnataka Appellate Authority for Advance Ruling held that the service is rendered to the foreign manufacturer and not to the Indian vehicle owner. Since the recipient is outside India and payment is received in convertible foreign exchange, the transaction qualifies as export of service and is zero-rated.
What it means for you: Where a foreign principal owns the warranty obligation and pays you for honouring it, the recovery can be defended as an export of service.
Notification No. 12/2019-Central Tax (Rate), dated 31 July 2019 · 2019-07-31
With effect from 1 August 2019 the GST rate on electrically operated vehicles, including two-wheelers, three-wheelers and cars, was reduced from twelve per cent to five per cent, and chargers and charging stations for such vehicles were brought to the same five per cent rate. Electrically operated vehicles were defined as vehicles running solely on electrical energy from an external source or from batteries fitted to the vehicle. The five per cent rate on electric vehicles has survived every subsequent restructuring.
