The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. CBIC clarified how to classify printing contracts. Where the customer supplies the content and the printer supplies only paper and ink, the printing itself is the principal supply and the transaction is a composite supply of service. Where the printer supplies goods such as envelopes, cartons, letterheads or boxes carrying the customer's design, the goods are the principal supply and the transaction is a supply of goods. The test is which element dominates, not how the invoice is worded.
What to do about it: Printing houses and packaging suppliers in Chennai must apply the principal-supply test to fix rate and HSN, because the wrong classification is a standard scrutiny point.
