A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable.
