The Central Goods and Services Tax (Tenth Amendment) Rules, 2020 inserted Rule 8(4A) and Rule 8(4B), requiring an applicant for registration to authenticate the Aadhaar number of the promoter, partner or authorised signatory while submitting Form GST REG-01. Rule 9 was amended so that an application with successful Aadhaar authentication could be granted quickly, whereas failure to authenticate, or non-opting, triggered physical verification of the place of business and a longer processing period.

CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises. However, no refund is available to anyone who paid at the higher rate or did not claim the exemption, and the circular works through illustrations showing exactly which past positions stand closed.
Practical effect: Read any rate clarification circular alongside its regularisation paragraph, because that paragraph often extinguishes the entire exposure for earlier years.
Paschimanchal Vidyut Vitran Nigam Ltd v. Raman Ispat (P) Ltd — Supreme Court, judgment dated 17-07-2023 · 2023-07-17
The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. Rainbow Papers was confined to its own facts, where a resolution plan had been approved ignoring statutory dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.
What to do about it: For a Chennai business in liquidation, GST arrears will be paid only after secured lenders and workmen, which affects how recovery notices against the company should be handled.
