For the tax periods July 2017 to April 2021 the late fee on GSTR-3B was capped at Rs 1,000 per return, being Rs 500 each under the central and State laws, and at Rs 500 per return where the return was a nil return. The concession applied to returns furnished between 1 June 2021 and 31 August 2021. The same notification rationalised the late fee prospectively from June 2021, capping it at Rs 500 for nil returns, Rs 2,000 where turnover is up to Rs 1.5 crore, Rs 5,000 where turnover is between Rs 1.5 crore and Rs 5 crore, and leaving the normal Rs 10,000 ceiling for turnover above Rs 5 crore.

From the August 2022 return period the whole of the credit appearing in GSTR-2B must first be reported as credit available in Table 4(A), with ineligible and reversible credit then shown separately in Table 4(B). Reversals that can be reclaimed later, such as those under Rule 37, go into Table 4(B)(2) and the reclaim is reported in Table 4(D)(1). Only the net figure reaches the electronic credit ledger.

RSB Transmissions (India) Ltd v. Union of India — Jharkhand High Court, judgment dated 18 October 2022 · 2022-10-18

The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

Why this matters: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.

A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made.
