The Council recommended amending the GST laws to include online gaming and horse racing as taxable actionable claims. The decision reshaped the economics of the online real-money gaming industry and triggered large retrospective demand notices on gaming companies.

Exporters who imported inputs without paying integrated tax and compensation cess under the advance authorisation and export oriented unit exemption notifications were barred by Rule 96(10) from claiming refund of integrated tax paid on exports. The Board clarified that where such exporters subsequently paid the exempted tax and cess along with interest and had the bill of entry reassessed by the customs authorities, the exemption is treated as not having been availed and the refund already taken stands regularised.
Why this matters: Chennai exporters facing recovery of integrated tax refunds under Rule 96(10) can close the issue by paying the import duties with interest and getting the bill of entry reassessed.

Goods moved under a valid e-way bill which the purchaser cancelled without informing the seller. The goods were seized and penalty imposed under Section 129(3). Relying on the Supreme Court's decision in Satyam Shivam Papers, the High Court quashed the penalty and the appellate order, holding that intent to evade tax is mandatory for invoking Sections 129 and 130. Where the breach is minor and unintentional, the department should have proceeded, if at all, under Section 122.
Why this matters: A cancellation or defect caused by your customer, of which you had no notice, is a strong defence against a Section 129 penalty.
