Entry 12, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.

The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025.
