The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. How long can a departmental GST audit under Section 65 go on?

In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. What are OIDAR services under GST and who pays the tax on them?

Only if three conditions in Section 15(3)(b) are met: the discount was established under an agreement that existed before or at the time of supply, it can be linked to specific invoices, and the recipient reverses the input tax credit attributable to it. If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation.
