It further clarified that the exemption applies whether the meals are funded by government grants or by corporate donations, since the entry does not distinguish by source of funding. The clarification protected non-profit caterers running school feeding programmes from demands.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The Supreme Court upheld the levy of GST on lotteries, holding that the inclusion of actionable claims such as lottery, betting and gambling within the definition of 'goods' under Section 2(52) CGST Act is constitutionally valid and not discriminatory.
