After the failed first attempt at rollout, this notification substituted rules 138, 138A, 138B, 138C and 138D of the CGST Rules with a redrafted set. The revised rules refined who must generate the e-way bill, introduced clearer treatment of transport by rail, air and vessel, addressed transfer of goods between conveyances and consolidated e-way bills, and rationalised the validity period and the list of exempt movements.
How we apply it: The e-way bill rules a Chennai business follows today are substantially the version substituted by this notification, so older commentary written before March 2018 can be misleading.

The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.
What to do about it: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

A consignment of power weeders was intercepted on 6 March 2023 at about 10.30 a.m., the e-way bill having expired at 11.59 p.m. the previous night. The taxpayer pleaded a vehicle breakdown. The Court declined to interfere, noting that the validity could have been extended within the permitted window and had not been, and that the officer's decision to detain and penalise under Section 129(1) was not unreasonable. The writ petition was dismissed with liberty to file a statutory appeal.
Why this matters: Chennai transporters must extend e-way bill validity within the permitted window when a vehicle breaks down; the High Court will not excuse an expired bill merely because of a breakdown.
