CBIC gave the pharmaceutical trade two options for goods returned because they have crossed their expiry date. The retailer or wholesaler may return them by issuing a fresh tax invoice, in which case the manufacturer takes input tax credit and must reverse it when the goods are destroyed. Alternatively the goods may be returned against a credit note issued by the manufacturer, whose tax liability reduces only if the credit note is issued within the time limit in section 34.
Practical effect: Pharma distributors and chemists in Chennai should agree in advance which route they will follow, because the credit-note route fails if the section 34 time limit has passed.

The Council extended the due date for GSTR-9, GSTR-9A and GSTR-9C for FY 2017-18 to 30 June 2019 and approved clarificatory changes to the forms. The headings were amended so that the return reports supplies made during the year rather than as declared in returns filed during the year. All GSTR-1 and GSTR-3B returns had to be filed first, additional tax had to be paid through DRC-03 in cash, and no fresh input tax credit could be claimed through GSTR-9 or GSTR-9C.
What to do about it: The rule set here still governs annual returns — GSTR-9 is a reporting exercise, and any short payment discovered must be settled in cash through DRC-03, never by using credit.

For FY 2023-24 onwards, Table 8A of the annual return GSTR-9 is auto-populated from GSTR-2B instead of GSTR-2A, following Notification No. 12/2024 and 20/2024-Central Tax.
