CBIC clarified that where a director rents out immovable property to the company in his personal capacity rather than as a director, the reverse charge entry for director's services does not apply and the ordinary forward charge rules govern. It also clarified that supply of food and beverages in cinema halls is taxable as a restaurant service at five per cent without input tax credit, unless the sale of the ticket and the food are clubbed as a composite supply with the ticket as the principal supply.

Many taxpayers paid tax through Form DRC-03 in response to a notice, yet the demand continued to show as outstanding in the electronic liability register because the payment was never linked to the order. The new rule introduced Form GST DRC-03A, through which such a payment can be mapped to the corresponding demand order so that the liability register is updated and recovery, interest and penalty computations stop. The facility went live on the portal from November 2024.

What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else.
