Man-made fibre and yarn, which had long been taxed higher than the cloth made from them, were also brought down, largely correcting the inverted duty structure that had troubled the Tamil Nadu textile belt since 2017.

Where the input tax credit availed in GSTR-3B exceeds the credit available in GSTR-2B by more than the prescribed limit, the portal issues an intimation in Form GST DRC-01C. The taxpayer must reverse the excess with interest through DRC-03 or file a reply in Part B giving reasons, within seven days. If neither is done, the filing of the next GSTR-1 or Invoice Furnishing Facility statement is blocked.

Circular No. 76/50/2018-GST dated 31 December 2018 · 2018-12-31

This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.

How much time does the GST department have to issue a demand under Section 73?

What are the exact steps to file a DRC-03 voluntary payment on the GST portal?
Log in and go to Services, then User Services, then My Applications, choose Intimation of Voluntary Payment DRC-03 and click New Application. Select the cause of payment, such as voluntary, show cause notice, audit or annual return, pick the section and financial year, and enter the tax, interest and penalty amounts head-wise under IGST, CGST and SGST. A saved draft remains available for fifteen days. Offset the amounts from your ledgers, sign with DSC or EVC, and download the ARN acknowledgement. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. The law requires the audit to be completed within three months from its commencement, which is the date the officers receive all the records they asked for. Where the Commissioner is satisfied that the audit cannot be completed in that time, he may record reasons and extend it by a further period not exceeding six months. In practice, audits drag when taxpayers supply records piecemeal, so submitting a complete, indexed set of documents at the start actually shortens the exercise. Track every submission with an acknowledgment, because the commencement date and the timeline arguments may matter later if disputes arise.
I received an ASMT-10 scrutiny notice for my Nandanam business. What exactly is it?

For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation.
