Following the 50th GST Council meeting, CBIC clarified that supply of food and beverages at the snack counters of a cinema hall is taxable as restaurant service at 5 per cent without input tax credit, provided it is supplied independently of the cinema exhibition service. Where a ticket and food are clubbed into a single package, the transaction is a composite supply with exhibition as the principal supply and the ticket rate applies to the whole amount.

The option is exercised by filing the Annexure V declaration on the GST portal. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. Is GST charged before or after the discount shown on my invoice?
