In an ex-works contract, title and risk pass at the supplier's factory gate when goods are handed over to the carrier arranged by the buyer, even though physical delivery to the buyer happens later. CBIC clarified that the condition of receipt of goods in Section 16(2)(b) is satisfied at that point through the deemed-receipt provision, so the buyer may claim input tax credit in that period, subject to actual receipt, use in business and the other conditions of Section 16.
What it means for you: Buyers on ex-works terms, common in the automobile supply chain, need not defer credit to the month of physical arrival at their premises.

Persons apprehending arrest in a fake invoice investigation sought protection on the ground that no assessment or adjudication had been completed. The High Court declined relief, holding that where the Commissioner has reasons to believe that offences under Section 132 have been committed, the power of arrest under Section 69 is not conditional on prior determination of tax. The Court did, however, stress that the power is to be exercised with due care and on recorded satisfaction.
Practical effect: In serious fake-invoice matters the department can act before adjudication, so early legal advice at the summons stage is essential.
Notification No. 21/2021-Central Tax (Rate), dated 31 December 2021 · 2021-12-31
On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.
Why this matters: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.
