CBIC issued comprehensive FAQs on the Section 128A scheme covering FY 2017-18 to 2019-20 Section 73 demands. Key points: the waiver covers interest and penalty but not the tax itself, payment must generally be made through Form DRC-03 or against the demand order by 31 March 2025, pending appeals or writ petitions must be withdrawn, the waiver does not extend to erroneous refund demands or amounts already paid as interest or penalty, and partial-period demands need careful bifurcation.
Practical effect: Before applying under the amnesty, withdraw related appeals and pay the full disputed tax for the covered years, as any shortfall forfeits the entire waiver.

To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.
How we apply it: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.
GST Appellate Tribunal (Procedure) Rules, 2025 — G.S.R. 256(E) dated 24 April 2025 · 2025-04-24
The Government notified the procedural framework for the long-awaited GST Appellate Tribunal under Section 111 of the CGST Act, providing for mandatory electronic filing of appeals through the GSTAT e-filing portal, rules for constitution and sitting of benches, powers of the Registrar, hybrid hearings and defined procedural timelines. The Tribunal began accepting appeals from September 2025 and commenced hearings from December 2025, with a Principal Bench at New Delhi and State Benches across the country, including Tamil Nadu.
Why this matters: Second appeals against first-appellate orders must now be e-filed on the GSTAT portal in the prescribed form, so physical or email filing will not stop limitation running.
