The Supreme Court interpreted Section 6(2)(b) of the CGST Act. It held that a summons under Section 70 is only an inquiry or evidence-gathering step and does not amount to "initiation of proceedings"; proceedings begin when a show cause notice is issued. "Subject matter" means the same cause of action in the same dispute. Once one authority issues a notice on a subject matter, the other authority cannot start parallel proceedings on that identical subject matter.
Why this matters: A Chennai business receiving summons from both the State GST wing and DGGI cannot object merely on that ground, but can resist a second show cause notice on the same issue and period.
GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24
GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.

Notification No. 08/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
Section 9(4) of the CGST Act as originally enacted made a registered person liable to pay tax under reverse charge on all inward supplies received from unregistered persons. This notification granted a de minimis exemption where the aggregate value of such supplies received from all unregistered suppliers did not exceed Rs 5,000 in a day. The exemption proved unworkable in practice and section 9(4) was soon suspended altogether.
What to do about it: This threshold only matters for the July to October 2017 period, and Chennai businesses still facing scrutiny for those months should check the daily aggregate rather than invoice-wise values.
