A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The Tamil Nadu AAR, by Order No. 20/AAR/2022 dated 31 May 2022, held that this recovery is consideration for a supply of canteen service and attracts GST, and the Appellate Authority upheld that ruling by its order dated 5 May 2023. The Tamil Nadu position is stricter than rulings in Gujarat and Maharashtra, which treated similar recoveries as non-taxable employee perquisites.

A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.
