From FY 2024-25 onwards, the separate three-year and five-year regimes of Sections 73 and 74 are replaced by a single Section 74A. The show cause notice must issue within forty-two months of the due date for furnishing the annual return, and the order within twelve months of the notice, extendable by six months, irrespective of whether fraud is alleged. Penalty still varies with conduct: ten per cent of tax in ordinary cases and fifteen, twenty-five or fifty per cent in fraud cases depending on when payment is made.
Practical effect: For 2024-25 and later years the department has a longer, uniform window to raise demands, so retain records and reconciliations for at least five years after each annual return.

Taking a view contrary to the Calcutta High Court's Suncraft line, the Patna High Court held that input tax credit is a concession conditional upon actual payment of tax to the Government under Section 16(2)(c); where the supplier collected tax but failed to remit it, the purchasing dealer cannot claim credit merely by showing invoices and payment to the supplier, and the buyer's remedy lies against the erring supplier. The divergence keeps this issue alive across jurisdictions.
What it means for you: Because High Courts are split on supplier-default ITC, do not rely on litigation alone — enforce vendor payment tracking, GSTR-2B matching and contractual GST indemnities.

CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.
Practical effect: Chennai courier, advertising and data centre businesses should map their invoices to these tests before deciding between IGST and CGST plus SGST.
