The Board answered a set of service classification and exemption questions arising from the 47th GST Council meeting. Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.
Practical effect: Chennai plot developers can rely on this circular for the position that a plot sale price is not taxable, but must still bear GST on the development works they buy in from contractors.
48th GST Council Meeting (video conferencing) — 17 December 2022 · 2022-12-17
The Council recommended decriminalising parts of the GST regime. The minimum threshold of tax for launching prosecution under Section 132 was raised from Rs 1 crore to Rs 2 crore, except for the offence of issuing invoices without any supply. The compounding amount was reduced from the range of 50 to 150 per cent of tax to 25 to 100 per cent. Three offences were decriminalised altogether: obstructing or preventing an officer in the discharge of duties, deliberate tampering with material evidence, and failure to supply information.
What it means for you: Ordinary compliance failures below Rs 2 crore of tax no longer expose a Chennai proprietor to criminal prosecution, though fake invoicing remains prosecutable at any value.

A Chennai limited liability partnership provided software development support to its overseas holding company and received amounts described as reimbursement of costs incurred. The Appellate Authority held that GST is leviable on the reimbursement, the receipt being in substance an advance payment by the holding company towards the cost of providing software services. Calling a receipt a cost reimbursement does not take it outside the scope of supply where an identifiable service is in fact being rendered to the payer.
What it means for you: Chennai back offices billing a foreign parent at cost must still test the transaction as a supply and document why it qualifies as export.
