The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

Reverse charge on unregistered purchases deferred again to 30 June 2018

26th GST Council Meeting, New Delhi — 10 March 2018 (PIB Release ID 1523715) · 2018-03-10

The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.

What it means for you: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.

Notification No. 11/2025-Central Tax · 2025-03-27

CBIC amended Rule 164 to resolve a practical roadblock in the Section 128A scheme. Where a single notice or order spans FY 2017-18 to 2019-20 as well as periods outside the scheme, the taxpayer may pay the tax attributable only to the covered period and need not withdraw the whole appeal, a new proviso permitting partial withdrawal limited to the covered period while the appeal continues for the balance. The amendment also confirms that no refund arises for tax, interest or penalty already discharged for the entire period.

What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment.
