The Council approved in principle four draft GST Rules covering Input Tax Credit, Valuation, Transitional Provisions and Composition, and approved the amended versions of five rules already cleared earlier, namely Registration, Return, Payment, Refund, and Invoice and Debit or Credit Note. A Division Bench of the Madras High Court upheld the validity of Section 54(3)(ii) CGST Act and Rule 89(5), holding that Parliament consciously restricted refund of unutilised ITC under the inverted duty structure to credit accumulated on input goods, and that excluding input services from the refund formula is neither ultra vires nor unconstitutional. This view, which conflicted with the Gujarat High Court's VKC Footsteps ruling, was later affirmed by the Supreme Court.
Why this matters: Inverted duty refund computations for Tamil Nadu businesses must exclude input service credits — structure contracts and procurement with this settled limitation in mind.

Invoking Section 168A once more, CBIC extended compliances whose due dates fell between 15 April 2021 and 29 June 2021 to 30 June 2021. The first notification of 1 May 2021 set the outer date at 31 May 2021 and the second of 1 June 2021 moved it to 30 June 2021. The relief covered completion of proceedings, passing of orders, issue of notices, filing of appeals, replies and applications, but excluded return filing and tax payment which were dealt with separately.
Practical effect: Any appeal, reply or refund application that fell due during the second wave gets the benefit of this extension, which is worth checking before conceding that a claim is time-barred.
