Notification No. 6/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13
Acting on the 47th GST Council recommendation, this notification rewrote the goods schedule so that curd, lassi, buttermilk, paneer, honey, cereals, pulses, flour, jaggery, puffed rice and similar staples attract five per cent when they are pre-packaged and labelled. The earlier test of whether the goods carried a registered brand name was abandoned, because it had been widely defeated by suppliers voluntarily forgoing brand registration. The change took effect from 18 July 2022.
What it means for you: From July 2022 a Chennai rice or flour dealer selling in labelled retail packs charges five per cent even if the pack carries no registered brand.

A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.
Practical effect: Chennai businesses should treat CBIC circulars as useful administrative guidance, but should not rely on one that conflicts with the plain words of the GST Act.

Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.
What to do about it: If a registration query asks for documents outside the prescribed list, cite this instruction in your REG-04 reply and escalate to the jurisdictional Commissioner if it persists.
