The Madras High Court partly allowed the petition, sustaining the seizure but modifying the prohibition order and directing provisional release of the goods on a personal bond plus a deposit of Rs. 2 lakh. The Court noted that the officers had not produced the material on which their reason to believe was founded, and took into account the severe business disruption caused by the pandemic.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
What it means for you: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.

CBIC capped the late fee for pending GSTR-9 annual returns of FY 2017-18 to 2021-22 at Rs 20,000 per year if filed between 1 April and 30 June 2023 (extended to 31 August 2023). It also rationalised the late fee prospectively from FY 2022-23: taxpayers with turnover up to Rs 5 crore pay Rs 50 per day capped at 0.04 per cent of turnover, with a Rs 100 per day slab for turnover between Rs 5 crore and Rs 20 crore.
