RSB Transmissions (India) Ltd v. Union of India — Jharkhand High Court, judgment dated 18 October 2022 · 2022-10-18

The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

What to do about it: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.

GST 2.0 exemption list: UHT milk, paneer and Indian breads made nil-rated

Notification No. 10/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

Superseding the 2017 exemption notification, this list re-notifies all nil-rated goods with effect from 22 September 2025 and widens it significantly. Ultra-high temperature milk became exempt, chena and paneer became exempt whether or not pre-packaged and labelled, and all Indian breads including roti, chapathi, paratha, parotta, khakhra and pizza bread were exempted by name. Pencils, crayons, sharpeners, slates, maps, globes and exercise books were also brought to nil.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Which input tax credits are blocked under Section 17(5) even if they appear in GSTR-2B?
Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. An amount deposited under one combination, say CGST-penalty, cannot be directly used to pay under another, say IGST-tax, which is why your balance appears unusable despite money lying in the ledger. The remedy is Form PMT-09, which transfers the amount to the correct head instantly without any officer approval.
