The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. What is the late fee for filing GSTR-9 after the due date?
From FY 2022-23 onwards, the late fee is turnover-linked. For turnover up to Rs.5 crore it is Rs.50 per day (Rs.25 CGST plus Rs.25 SGST) capped at 0.04 percent of turnover; for turnover between Rs.5 crore and Rs.20 crore it is Rs.100 per day with the same cap; and above Rs.20 crore it is Rs.200 per day capped at 0.5 percent of turnover. The fee accrues until the date of filing, so delays get expensive for larger businesses. Filing before 31 December avoids the entire cost.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Guindy trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
What is the difference between a GST credit note and a commercial credit note?
A GST credit note is issued under Section 34, is reported in GSTR-1, and reduces your output tax, with the buyer reversing equivalent input credit. A commercial or financial credit note adjusts only the money owed between the parties; it carries no GST, is not reported in returns, and leaves everyone's tax position untouched. Businesses use commercial credit notes when the 30 November deadline has passed, or for post-supply discounts that do not satisfy the statutory conditions for a tax adjustment. Choosing the wrong instrument is a frequent audit finding, so decide the type before the note is issued.
What is the GST rate for salons, gyms and yoga centres?
From 22 September 2025, beauty and physical well-being services, covering salons, barbers, beauty parlours, gyms, fitness centres and yoga institutes, attract 5 percent GST without input tax credit, reduced from the earlier 18 percent. The condition attached to the concessional rate is important: because credit is barred, the GST paid on your rent, equipment, cosmetics and consumables becomes part of your cost base. Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt.
