Krishna Bhavan Foods and Sweets - AAR Tamil Nadu, Order No. TN/24/AAR/2021, dated 18 June 2021, upheld by AAAR Tamil Nadu, Order No. TN/AAAR/02/2022, dated 13 January 2022 · 2021-06-18

The applicant sold packaged ready to cook instant mixes for dosai, idli, tiffin items, sweets, health mix and porridge. It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

What to do about it: Chennai food manufacturers selling instant mixes should confirm whether the product is a plain flour or a preparation before applying 5 percent.

Notification No. 13/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

This notification replaces the entire table in the 2018 handicrafts notification with a fresh list of about thirty-nine entries from 22 September 2025. Most items carry central tax of 2.5 per cent, that is five per cent combined: handcrafted candles, carved and inlaid wood products, wooden frames, art ware of cork and sholapith, vegetable-fibre mats and basketwork, handmade paper, papier mache articles, coir goods, handmade carpets, stone carving, ceramic and glass art ware, brass and copper art ware, wooden toys, hand paintings and original sculptures. Silver filigree work and handmade imitation jewellery, including jewellery of natural seeds and beads, carry 1.5 per cent central tax, that is three per cent combined.

What to do about it: Handicraft retailers in Chennai charge five per cent on the general run of handicraft goods, but must apply three per cent to silver filigree work and handmade imitation jewellery.

Amnesty capping late fee at Rs 500 or Rs 1,000 for pending GSTR-3B from July 2017 to April 2021

43rd GST Council Meeting (video conferencing) — 28 May 2021 · 2021-05-28

The Council announced an amnesty scheme reducing late fee on pending GSTR-3B returns for the tax periods from July 2017 to April 2021. For taxpayers with no tax liability in those periods the late fee was capped at Rs 500 per return, and for others at Rs 1,000 per return, in each case counting central and state tax together. The reduced late fee applied only where the returns were furnished between 1 June 2021 and 31 August 2021, a window later extended to 30 November 2021.

What to do about it: Taxpayers who cleared four years of pending returns in this window paid a fraction of the statutory late fee, which is why acting promptly in an amnesty window matters so much.

Why is the portal not letting me file GSTR-1?

The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
My landlord in Guindy has no GSTIN but my business is registered. Who pays GST on the shop rent?
You do. With effect from 10 October 2024, renting of immovable property other than a residential dwelling by an unregistered person to a registered person was brought under reverse charge through Notification 09/2024-Central Tax (Rate). So a registered trader renting a shop from an unregistered landlord must pay 18 percent under RCM through GSTR-3B and can claim it back as input tax credit if eligible. Composition taxpayers have since been kept outside this entry, given they cannot claim credit. Our Guindy factory hires lorries through a transport agency. Who pays the GST?
Under the reverse charge entry, when a GTA that has not opted for forward charge provides service to specified recipients, the recipient pays the 5 percent tax. Specified recipients include factories, registered persons, body corporates, partnership firms including AOPs, co-operative societies and casual taxable persons. Your factory therefore pays 5 percent in cash through GSTR-3B, reports it in the reverse charge tables, and claims the same amount as input tax credit since freight is a business expense. Confirm from the transporter's invoice or declaration whether it has opted for forward charge, because paying RCM on an FCM invoice creates double taxation. Do I have to pay GST on my Adobe, Canva or AWS subscriptions billed from abroad?
If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. You must pay the tax in cash through GSTR-3B, raise a self-invoice, and can simultaneously claim the same amount as input tax credit if the expense is otherwise eligible, making it cash-flow neutral for most businesses. Unregistered persons do not pay reverse charge; instead, the foreign provider may charge GST under the OIDAR rules. Many Guindy agencies miss these entries during scrutiny.
I received an intimation in DRC-01C about ITC mismatch. How do I respond?
DRC-01C is issued under Rule 88D when the ITC claimed in your GSTR-3B exceeds the ITC available in GSTR-2B beyond the permitted limits. You must respond within seven days, either by paying the excess with interest through DRC-03 or by explaining the difference in Part B of DRC-01C, citing valid reasons such as credits of earlier periods claimed within time, reclaims after Rule 37 payment, or import ITC not flowing through 2B. Is ITC available on food, catering and canteen expenses for our factory staff?
Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. First, where you use catering as an input for making an outward supply of the same category, such as a caterer subcontracting another caterer, credit is allowed. Second, where providing the facility is obligatory for the employer under any law, credit is allowed; the classic case is a statutory canteen required under the Factories Act for factories employing more than 250 workers. Even then, credit is typically restricted to the cost borne by the employer, not amounts recovered from employees. Factories around Guindy should keep the statutory obligation documented in their credit file.
My buyer has not accepted my credit note. Does that affect my tax reduction?
Yes. Your output tax reduction on a credit note is conditional on the corresponding input tax credit being reversed by the recipient. Practically, this means credit notes need commercial agreement before they are reported, not after. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
Our head office in Guindy supports branches in other states. Is a cross-charge invoice really required?
Yes. Branches with separate GSTINs are distinct persons, and Schedule I treats supplies between them as taxable even without consideration. Services your head office renders to branches, such as accounting, IT support or management oversight, should be cross-charged through a tax invoice with IGST, which the branch claims as credit. What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
