Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
Practical effect: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.

The department sought reversal of ITC under Section 17(5)(h) CGST Act on the portion of inputs lost inherently during the manufacture of steel — burning loss and the like. The Madras High Court held that Section 17(5)(h), which blocks credit for goods lost, stolen, destroyed or written off, contemplates loss of the goods as such; it does not cover consumption or invisible loss inherent to the manufacturing process, so no reversal was warranted.
What to do about it: Manufacturers facing scrutiny demands for process loss, evaporation or burning loss should cite this ruling — inherent manufacturing loss does not trigger ITC reversal.

Where the input tax credit availed in GSTR-3B exceeds the credit available in GSTR-2B by more than the prescribed limit, the portal issues an intimation in Form GST DRC-01C. The taxpayer must reverse the excess with interest through DRC-03 or file a reply in Part B giving reasons, within seven days. If neither is done, the filing of the next GSTR-1 or Invoice Furnishing Facility statement is blocked.
