The Madras High Court quashed the orders, holding that when the seller has collected tax, the department must first examine and initiate recovery against the defaulting seller; omitting to examine the sellers despite their pivotal role vitiated the proceedings, and the matter was remanded for fresh enquiry involving them.

The Board clarified that ducts and manholes used in laying networks of optical fibre cables fall within the expression plant and machinery in the explanation to Section 17.
