CBIC distinguished two situations. Where a seller himself sells goods on instalments and charges additional interest for delayed payment, that interest is part of the value of the goods under section 15(2)(d) and bears the same rate as the goods. Where the buyer takes a loan from a bank or non-banking finance company and that lender charges penal interest on delayed equated monthly instalments, the interest is consideration for extending a loan and is exempt under Notification No. 12/2017-Central Tax (Rate).
What to do about it: Chennai dealers offering their own instalment schemes must charge GST on late-payment interest, unlike a financier's penal interest which is exempt.

The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.
Practical effect: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.
34th GST Council Meeting (video conferencing) — 19 March 2019 · 2019-03-19
The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.
What it means for you: Chennai builders who did not formally exercise the option in 2019 are on the one and five per cent no-credit rates, and any credit claimed since then is exposed to reversal.
