This circular settled four recurring questions. Perquisites provided by an employer to an employee under a contractual employment agreement are not liable to GST. The proviso to Section 17(5)(b) applies to the whole of that clause, so credit is available where a supply is obligatory under any law in force. The electronic credit ledger may be used to pay output tax, including tax demanded under Sections 73 and 74, but never for reverse charge liability, interest, penalty or fees.
What to do about it: Chennai employers can stop charging GST on contractual staff perquisites, but must always pay reverse charge tax, interest and penalty in cash even when the credit ledger has a large balance.

Goods were detained and penalised because Part B of the e-way bill had not been filled in, although the tax invoice and Part A carried all the required details and there was no dispute about the goods or their value. The High Court held that non-filling of Part B, without any material showing an intention to evade tax, is a technical breach that does not attract penalty under Section 129. The penalty was set aside and refund of the deposit directed.
Practical effect: For a Part B omission with correct invoices, argue absence of intent to evade — the Section 129 penalty is usually not sustainable on those facts.

CBIC notified a special procedure under Section 148 allowing taxpayers against whom orders under Sections 73, 74, 107 or 108 confirmed demands for wrong availment of ITC solely due to the Section 16(4) time limit, and who had not appealed, to apply electronically within six months for rectification. The adjudicating authority must re-examine the demand in light of the retrospective Sections 16(5) and 16(6) and pass a rectified order, ordinarily within three months.
Why this matters: Old ITC-time-limit demands did not need a fresh appeal; a portal rectification application citing this notification could get the order corrected and the demand dropped.
