Megha Engineering and Infrastructures Ltd v. Commissioner of Central Tax — Telangana High Court, judgment dated 18 April 2019 · 2019-04-18
The taxpayer filed GSTR-3B late and paid interest only on the net cash portion of the tax. The High Court held that on the language of Section 50 as it then stood, interest ran on the gross liability, because input tax credit is credited to the ledger only when the return is filed. The decision caused wide concern in trade, and Parliament later amended Section 50 with retrospective effect from 1 July 2017 to charge interest only on the cash component in most late-return cases.
What it means for you: For late returns, interest is now generally computed on the cash portion only — if an older notice demands interest on gross tax, rely on the retrospective proviso to Section 50.
GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.
What it means for you: If you settled 2017-20 demands under the amnesty, preserve the SPL filings and payment proofs; if you missed it, factor full interest into dispute strategy.

For supplies received from unregistered persons that are taxable under reverse charge, CBIC clarified that the Section 16(4) time limit for availing input tax credit is reckoned from the financial year in which the recipient issues the self-invoice, not the year of the supply itself. Where the self-invoice is issued belatedly, the recipient may still claim credit but is liable to interest for delayed tax payment and possible penal action for the documentation delay.
Practical effect: Missed reverse-charge liabilities of earlier years can still be regularised with credit intact by issuing the self-invoice now and paying tax with interest.
