CBIC notified the GSTR-3B due dates for the six months from October 2020 to March 2021. Taxpayers with aggregate turnover of Rs 5 crore or more in the preceding financial year filed by the 20th of the following month. Taxpayers below that threshold filed by the 22nd or the 24th depending on the State in which their principal place of business was located, with Tamil Nadu falling in the 22nd group. It ceased to matter from January 2021, when the quarterly scheme and the rewritten Rule 61 took over the return calendar.
Practical effect: For the 2020-21 comparison periods, a Chennai taxpayer below Rs 5 crore was due on the 22nd, which matters when interest is computed on a delayed return of that year.

The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
What to do about it: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.

The Court directed immediate release on furnishing a bank guarantee and, importantly, directed the assessing officer to consider whether the lapse was a substantive violation or only a technical breach, having regard to Sections 122, 125 and 126 of the CGST Act. Adjudication was to be completed within four weeks, with amounts already remitted by the transporter adjusted against the final determination.
Practical effect: A Chennai consignor whose goods are held for a stale e-way bill can seek release against security while pressing that Section 126 requires leniency for minor procedural lapses.
