The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

What to do about it: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Torrent Power Ltd v. Union of India — Gujarat High Court, R/Special Civil Application No. 5343 of 2018, judgment dated 19 December 2018 · 2018-12-19

Circular No. 34/8/2018-GST had stated that services such as meter rent, application fees and shifting of lines supplied by an electricity distribution utility are taxable separately. The High Court struck down paragraph 4(1) of that circular, holding that these services are naturally bundled with the exempt supply of transmission and distribution of electricity and therefore take the character of the principal exempt supply. A circular cannot narrow the scope of an exemption notification.

Several appellate authorities were refusing to decide appeals on the ground that the GST Appellate Tribunal did not exist. CBIC clarified that this is not a valid reason to defer disposal, and that under the Removal of Difficulty Order the three-month period for filing an appeal to the Tribunal starts only from the date on which the President of the Tribunal enters office. Appellate authorities were directed to record this position in their orders so that appellants are not prejudiced.

Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC.
