CBIC clarified that an Indian data hosting provider serving an overseas cloud computing company acts on a principal-to-principal basis and is not an intermediary. The service is not supplied in relation to goods made available by the recipient, nor does it relate to immovable property, since it is a bundle of hosting, power, cooling and connectivity rather than a lease of premises. The place of supply is therefore the recipient's location abroad and the supply qualifies as an export of services.
What to do about it: Chennai data centre and hosting operators billing foreign cloud companies can treat the supply as zero-rated and file refunds of accumulated credit.
