Circular No. 137/07/2020-GST dated 13 April 2020 · 2020-04-13

CBIC answered questions arising from cancelled bookings and returned goods. Where an advance was received, tax paid and an invoice issued, and the contract was later cancelled, the supplier issues a credit note under section 34 and adjusts the liability; where only a receipt voucher was issued, he issues a refund voucher and claims refund of the excess tax paid in FORM GST RFD-01. It also confirmed that a Letter of Undertaking for 2020-21 could be filed up to 30 June 2020 while quoting the previous year's LUT number.

Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.

Practical effect: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.

Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. We are constructing our own office building in Korattur. Can we claim ITC on the materials and contractor bills?
No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. I paid my supplier only part of the invoice within 180 days. How much ITC do I reverse?
The reversal is proportionate. If you paid sixty percent of the invoice value including tax within 180 days, you reverse only the ITC attributable to the unpaid forty percent, reporting it in Table 4(B)(2) of the GSTR-3B for the tax period immediately following the expiry of the 180 days. Amounts settled through book adjustments, such as netting off mutual dues or debit notes for quality deductions reducing the payable, have been accepted as payment in advance rulings, so a properly documented ledger adjustment protects the credit. Retention money held under contract terms is the most common trigger we see in Korattur construction and job-work businesses.
I make both taxable and exempt supplies. How is the Rule 42 credit reversal actually computed?
Rule 42 first removes credit exclusively for exempt supplies and non-business use, and credit exclusively for taxable supplies, leaving the common credit. From this common pool, you reverse the portion equal to exempt turnover divided by total turnover for the month, plus a flat five percent of the common credit where inputs are partly used for non-business purposes. The reversal is declared monthly in GSTR-3B, and a final recomputation for the whole year must be done, with any shortfall paid with interest, by the November return following the financial year. What is the difference between the electronic cash ledger and the electronic credit ledger?

What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
Why is there GST on an under-construction flat but not on a ready-to-move one?
Construction of an apartment intended for sale is a supply of service only when any part of the consideration is received before the completion certificate is issued or before first occupation. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
Is there really a penalty for not displaying my GST number at my shop?
Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty. Inspection teams visiting Korattur markets routinely check name boards first, so a few hundred rupees of signage is the cheapest compliance in the entire GST law.
