The dual-control deadlock that had stalled several earlier meetings was broken. The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.
Practical effect: This is why a Chennai taxpayer is assigned either to the Tamil Nadu Commercial Taxes Department or to CGST Chennai, and why notices come from only one of them for routine matters.

Refund claims for unutilised credit on zero-rated exports of July to September 2017 were filed on 21 September, 9 October and 10 October 2018, returned through deficiency memos, and resubmitted later. The appellate authority treated the resubmissions as fresh applications and rejected them as time-barred. The Court allowed three of the five petitions and quashed those orders, holding that the original applications were within two years of the exports and that a resubmission after curing deficiencies cannot start a new limitation period, the 2021 proviso to Rule 90(3) not applying retrospectively.
What to do about it: Chennai exporters whose refund was returned by a deficiency memo should preserve the original ARN and acknowledgement — limitation is counted from that first filing, not the re-filed one.

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.
Why this matters: The tax gap between an electric two-wheeler at five per cent and a petrol motorcycle at eighteen per cent is now the single biggest pricing lever for Chennai vehicle dealers.
