Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.
What it means for you: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.
LGW Industries Ltd v. Union of India — Calcutta High Court, 2021 · 2021-12-13
Buyers were denied ITC because their suppliers were later found non-existent and their registrations cancelled with retrospective effect. The Calcutta High Court remanded the matter, directing the authorities to verify whether the purchases were genuine, supported by valid invoices, made through banking channels, and effected before the cancellation; if the buyers acted in good faith after verifying the suppliers' registration on the portal, the benefit of input tax credit should not be denied to them.
What it means for you: Preserve portal verification screenshots, invoices, transport and bank records for every vendor — good-faith purchases made before a supplier's retrospective cancellation remain defensible.
46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31
The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.
