A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.
What to do about it: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.
CBIC Frequently Asked Questions on GST on pre-packaged and labelled goods, dated 17 July 2022 · 2022-07-17
A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.
Circular No. 40/14/2018-GST dated 6 April 2018 · 2018-04-06
In partial modification of Circular 8/8/2017, CBIC clarified that a Letter of Undertaking filed online in FORM GST RFD-11 is deemed accepted as soon as the application reference number is generated on the portal. No document needs to be physically submitted to the jurisdictional office, and no separate acceptance letter is required. If it is later found that the exporter was ineligible, the LUT is treated as having been rejected from the beginning.
Why this matters: Exporters need not chase the range office for an LUT acceptance letter; the ARN printout from the portal is sufficient proof.
