CBIC notified the classes of persons to whom the Aadhaar authentication requirement in Section 25(6D) does not apply. These are persons who are not citizens of India, departments or establishments of the Central or State Government, local authorities, statutory bodies, public sector undertakings, and persons applying for a Unique Identity Number under Section 25(9). For everyone else Aadhaar authentication remains the normal route, with physical verification of the premises as the alternative where authentication is not done.
What it means for you: A foreign national or a government body applying for a Chennai GSTIN cannot be pressed for Aadhaar authentication, and the application must be processed on the physical verification track.

CBIC confirmed that the death of a sole proprietor, where the business is continued by the successor, is a transfer of business for the purposes of section 18(3), so the unutilised input tax credit can be transferred to the transferee through FORM GST ITC-02. The successor must first obtain a new registration, the cancellation application for the deceased's registration is filed selecting death of proprietor as the reason, and the transferee accepts the credit on the portal.
How we apply it: A family taking over a proprietorship after a bereavement need not lose the credit balance, provided the ITC-02 is filed before the old registration is cancelled.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.
What to do about it: If a Chennai company is under moratorium, indirect tax officers may quantify dues but cannot attach property or auction goods to recover them.
