A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Why this matters: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Union of India v. M/s Willowood Chemicals (P) Ltd — Supreme Court, (2022) 9 SCC 341, judgment dated 19-04-2022 · 2022-04-19

The High Court had awarded exporters interest at nine per cent on refunds released after delays of a few months. Reversing that, the Supreme Court held that the main part of Section 56 of the CGST Act fixes interest at six per cent, and the higher nine per cent rate applies only under the proviso, that is where the refund arises from an order of an adjudicating authority, appellate authority, tribunal or court. Courts cannot apply equitable rates where the statute has spoken.

On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.

What to do about it: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.

The documents depend on the refund category. Export refunds under LUT need a statement of invoices with corresponding shipping bill numbers and dates, or FIRC and BRC for service exports. Inverted duty claims need statements of inward and outward supplies with the Rule 89(5) computation. All claims need a declaration that the tax incidence has not been passed on, and claims above Rs.2 lakh require a certificate from a chartered accountant or cost accountant in certain cases. I export goods after paying IGST. How do I get that tax back?
For export of goods with payment of IGST, no separate RFD-01 is needed. The shipping bill filed with customs is itself treated as the refund application once you file GSTR-1 with correct shipping bill details in Table 6A and pay the tax through GSTR-3B. Customs matches the data from the GST portal with ICEGATE and credits the refund directly to your bank account. Most delays happen because of invoice mismatches between GSTR-1 and the shipping bill, or bank account validation errors, so reconcile both before filing each month.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Madhavaram trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
What are the GST rates on silver articles, diamonds and gold coins?
Silver and articles of silver, like gold, attract 3% GST, and so do gold and silver coins. Cut and polished diamonds attract 1.5%, while rough diamonds are taxed at 0.25%. The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Madhavaram buying stationery from an unregistered shop has no Section 9(4) liability at all.
