Following the 55th GST Council meeting, CBIC clarified disputed classifications: ready-to-eat salted popcorn is taxable at 5 per cent (12 per cent if pre-packaged and labelled) while caramelised popcorn falls at 18 per cent as sugar confectionery; autoclaved aerated concrete blocks with over 50 per cent fly ash content attract 12 per cent; and dried pepper supplied by an agriculturist remains exempt. Past periods were regularised on an as-is-where-is basis to prevent retrospective demands.
How we apply it: Food processors and building-material traders should re-check product classifications against this circular, since regularisation protects past periods but the clarified rates bind future supplies.
38th GST Council Meeting, New Delhi — 18 December 2019 · 2019-12-18
The Council waived late fee for taxpayers who furnished all pending statements of outward supplies in GSTR-1 for the tax periods from July 2017 to November 2019, provided they were filed by 10 January 2020. It also decided that e-way bill generation would be blocked for taxpayers who had not filed GSTR-1 for two tax periods, extending the blocking mechanism that already applied to GSTR-3B defaulters. Standard operating procedures were prescribed for officers dealing with non-filers, and Grievance Redressal Committees were set up at zonal and state level.
Practical effect: GSTR-1 default now carries its own e-way bill block, so filing GSTR-3B alone is not enough to keep despatches moving.
Mineral Area Development Authority v. Steel Authority of India — Supreme Court, nine-judge Bench, (2024) 10 SCC 1, judgment dated 25-07-2024 · 2024-07-25
The Supreme Court held by majority that royalty payable under the mining law is a contractual consideration and not a tax. States retain legislative competence to impose taxes on mineral rights and on mineral-bearing land, and this power is not taken away by the central mining legislation. The Court overruled the contrary view taken in the earlier India Cement case, altering the fiscal position of mining and quarrying operations.
What to do about it: Chennai businesses in mining, quarrying or aggregates should factor State levies on mineral rights into costing alongside GST on the supply.
