CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

What to do about it: Apartment associations across Chennai should test both the Rs 20 lakh turnover and the Rs 7,500 per-flat tests, and remember that crossing the limit taxes the whole amount.

Notification No. 21/2021-Central Tax (Rate), dated 31 December 2021 · 2021-12-31

On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.

Practical effect: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.

Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.

Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
I received Form ADT-01 saying my business is selected for GST audit. What does it mean?
ADT-01 is the intimation that the department will conduct an audit of your records under Section 65. The notice must be issued at least fifteen working days before the audit begins and will specify the financial years covered and the documents required. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit. Use the fifteen-day window to reconcile your data and organise records rather than waiting for the officers to arrive. What happens if I do not reply to an ASMT-10 scrutiny notice?

If all three hold, you issue a GST credit note and reduce your output tax. If any condition fails, which is common for year-end volume incentives negotiated later, the adjustment must go through a commercial credit note without any GST effect. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice.
