The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.
What it means for you: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

A five-judge Bench held that an exemption notification must be interpreted strictly, and the burden of proving entitlement lies on the person claiming it. If there is genuine ambiguity in the wording of an exemption, the benefit of doubt goes to the revenue, not the taxpayer. This overruled the contrary view in Sun Export. The principle applies squarely to GST exemption and concessional rate notifications.
Practical effect: A Chennai business claiming a GST exemption or concessional rate must fit precisely within the notification's wording, as courts will not read it liberally.

From 18 July 2022 a goods transport agency may choose to pay tax itself instead of leaving it to the recipient under reverse charge. The option is exercised by filing a declaration in Annexure V with the jurisdictional officer before the financial year begins. Having opted in, the transporter charges tax on its own invoices, either at 5 per cent without input tax credit or at 12 per cent with full credit, and the recipient must not pay reverse charge on those bills.
What to do about it: Chennai manufacturers and traders must collect the Annexure V position of each transporter, because paying reverse charge on a forward-charge bill leads to a double payment that is hard to recover.
