The Central Goods and Services Tax (Tenth Amendment) Rules, 2020 inserted Rule 8(4A) and Rule 8(4B), requiring an applicant for registration to authenticate the Aadhaar number of the promoter, partner or authorised signatory while submitting Form GST REG-01. Rule 9 was amended so that an application with successful Aadhaar authentication could be granted quickly, whereas failure to authenticate, or non-opting, triggered physical verification of the place of business and a longer processing period.
Practical effect: A Chennai applicant who completes Aadhaar authentication gets the GSTIN in days, while skipping it invites a site visit by the officer and weeks of delay.

The 51st meeting recommended amendments to the CGST Act and IGST Act, including Schedule III, to tax supplies in casinos, horse racing and online gaming at 28 per cent. Valuation was fixed at the amount paid or payable to or deposited with the supplier by or on behalf of the player, excluding amounts staked out of winnings of previous games or bets, so the tax applies on entry deposits rather than on every bet. Suppliers of online money gaming located outside India were required to take a single simplified registration, failing which public access to their platforms can be blocked. The Council said the process of amending the Acts would be completed within two months, and the amendments were brought into force from 1 October 2023.
What it means for you: From 1 October 2023, gaming operators must pay 28 per cent on user deposits, and foreign platforms without Indian registration face blocking and enforcement.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
